Rate My Rep has created this privacy policy (the “Privacy Policy”) in accordance with its commitment to protecting users’ privacy and ensuring the safety of users’ Personal Information. This Privacy Policy applies to the Rate My Rep mobile application (the “App”), owned and operated by Rate My Rep, LLC (“Rate My Rep,” “we,” “us,” or “our”). Consistent with our dedication to transparency the Privacy Policy describes how Rate My Rep collects, uses, shares, discloses, and stores the information you may provide through the Web Sites or App. It also describes your rights and choices regarding our use of your Personal Information.

This Privacy Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with. Furthermore, it does not apply to information Rate My Rep collects offline.

In this Privacy Policy Personal Information (“Personal Information”) refers to any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a particular consumer or household.

We highly encourage you to read the Privacy Policy, and to use the information it contains to help you make informed decisions. If you do not consent to the practices described below, do not download, register with, or use the App, nor should you participate in the App or any features, activities, or services offered through the Web Sites.   1. INFORMATION WE COLLECT AND HOW WE COLLECT IT

    We collect Personal Information from and about users of our App in the following manner:

    (a) Directly from you such as when you submit information to us or allow us to access information about you;

    (b) Automatically when you use and interact with the App;

    (c) From third parties, when applicable.

    Information You Provide to Us

    When you use or access the App and its features you may provide the following types of Personal Information:

    (a) Contact information such as name, email address, and phone number;

    (b) Information related to the identity of your account and profile such as username, password, language, account ID, profile image, and security information used for authentication and account access;

    (c) Information related to your employment such as industry, company name, and job title/position.

    (d) Demographic information such as age, gender, citizenship, date of birth, and preferred language;

    (e) Information regarding your choices and communication preferences;

    (f) Information for publication or display on public areas of the app or websites you access through the App such as comments, photographs, videos, text, and audio recordings ("User Content");

    (g) Information that you provide when you report a problem with the App;

    (h) Financial information such bank account numbers, credit card or debit card numbers, account details, ACH information, and similar data at the time downloading the app;

    (i) Information that you provided when you when you enter a contest or promotion sponsored by us;

    (j) Records and copies of your correspondence (including email addresses and phone numbers), if you contact us;

    (k) Your search queries on the App; and

    (l) Any additional information about yourself that you voluntarily provide.

    Information We Collect Through Automatic Data Collection Technologies

    When you download, access, and use the App, we automatically collect certain information from you. This information does not reveal identifying information such as your name, however it may reveal device and usage information such as your IP address, location, and other unique device identifiers.

    (a) Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, User Content, and other communication data and the resources that you access and use on or through the App.

    (b) Device Information. We may collect information about your mobile device and internet connection used to access the App, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, mobile carrier, keystroke patterns or rhythms, audio settings and connected audio devices, and the device's telephone number.

    (c) Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

    (d) Location Information. This app may collect information about your device’s approximate location. The level of information collection will depend on your device’s setting. You have the right to opt out of us collecting this information by disabling the location settings on your device. However, please note that by disabling your location settings your ability to access location-based features of the App may be affected and/or limited.

    If you do not wish for us to collect this information, do not download the app or delete it from your device. For more information, see “the “Your Rights” section below.

    The technologies we use for automatic information collection may include:

    (a) Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our App.

    (b) Web Beacons. Pages of the App and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages, opened an email, or for other related app statistics such recording the popularity of certain app content and verifying system and server integrity.

    Third Party Information Collection

    Third parties may use automatic information collection technologies to collect information about you or your device when you download, access, or use the App. These third-parties may include:

    • Advertisers, ad networks, and ad servers.

    • Recruiters and hiring managers.

    • Analytics companies.

    • Your mobile device service provider and/or manufacturer.

    Some content or applications, including advertisements, on App are served by third-parties, including advertisers, ad networks, and servers, content providers, and application providers. These third-parties may use cookies (alone or in conjunction with web beacons or other tracking technologies) to collect information about You when You use this App. The information they collect may be associated with Your Personal Information or they may collect information, including Personal Information, about Your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide You with interest-based (behavioral) advertising or other targeted content.

    Rate My Rep does not control third-parties privacy practices and policies regarding your information. Please consult their applicable privacy policies regarding the collection, use, storage, or disclosure of your information. Additionally, please see the “Your Rights” section below to learn more about how to opt-out of the collection and/or use of information collected by third parties.

  2. HOW WE USE YOUR INFORMATION

    To improve our App and deliver a satisfactory and personalized experience, we use information that we collect about you or that you provide to us, including any Personal Information for the following purposes:

    (a) To present our App, its contents, and features to you;

    (b) To respond to your requests and other questions;

    (c) To respond to your questions or other requests;

    (d) To Provide you with information, products, or services that you request from us;

    (e) To provide you with notices about your account and subscription, respond to comments, questions, and provide customer service;

    (f) To enhance and improve the App, such as through personalized features and content;

    (g) To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;

    (h) To notify you about changes and updates to the App or its products, services, or polices;

    (i) To communicate about promotions, upcoming events, and other news about products and services offered by us and our selected partners;

    (j) To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our policies, or as otherwise required by law;

    (k) To solicit feedback;

    (l) For any other purposes disclosed at the time the information is collected or to which you consent; and

    (m) As otherwise specifically described in this Privacy Policy.

  3. THE SALE OF YOUR INFORMATION.

    In the preceding 12 months have we have not sold your Personal Information and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale.

  4. DISCLOSURE OF YOUR INFORMATION

    While we do not sell your Personal Information, for business purposes we may disclose or share the information we collect to third parties. Those categories of third parties are described below.

    Our Corporate Group/Family

    We do not own or operate any other entities in which we may share your Personal Information. However, in the future, should we own or operate additional entities we may share the information we collect with our subsidiaries and affiliates as necessary for them to use in any manner consistent with this Privacy Policy.

    Service Providers and Business Partners

    We may disclose your information to contractors, service providers, and other third-parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

    Business Transfers

    We may disclosure your Personal Information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by the Company about the App’s users is 4 among the assets transferred.

    Law Enforcement and Government Entities

    We may disclose your Personal Information to comply with any court order, law, or legal process, including to respond to any government or regulatory request.

    In addition, we may also disclose your Personal Information if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others, including exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

    Other Third parties

    In addition to the third parties described above we may disclose your Personal Information to the following:

    (a) Third-parties approved by you who wish to market their products or services to you. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them;

    (b) Individuals or entities as necessary to enforce or apply Our Terms of Use and other agreements, including for billing and collection purposes;

    (c) Industry recruiters and hiring managers; and

    (d) Others as necessary to comply with your instructions or consent.

    We will not share your Personal Information with any other third party not described above.

  5. YOUR RIGHTS

    You can review and change your Personal Information by sending us an email at info@ratemyrep.co to request access to, correct, or delete any Personal Information that you have provided to us. You may also request to delete your account in its entirety. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

    If you choose to contact us directly by email or in writing, you will need to provide us with:

    (a) Enough information to identify you (e.g., your full name, address and customer or matter reference number);

    (b) Proof of your identity and address e.g., a copy of your driving license or passport and a recent utility or credit card bill; and

    (c) A description of what right you want to exercise and the information to which your request relates.

    We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf. We will use commercially reasonable efforts to process such requests in a timely manner.

    If You delete your User Contributions from the app, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other App users. Proper access and use of information provided on the App, including User Contributions, is governed by our Terms of Use. Any Personal Information we collect from you to verify your identity in connection with you request will be used solely for the purposes of verification. In addition to modifying your Personal Information, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing e-mails. You cannot opt out of receiving transactional e-mails related to the App (e.g., requests for support).

  6. STATE PRIVACY RIGHTS.

    State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. The rights below are based on the following regulations:

    You have the right to be notified which categories of Personal Information are being collected and the purposes for which the Personal Information is being used.

    Right to Access (CCPA/CPRA, CPA, CTDPA, TDPA, UCPA, VCDPA)

    You have the right to access the Personal Information we may have collected about you. Requests to access your Personal Information may be submitted up to two times in a rolling twelve-month period. Upon viewing and verifying your request we will disclose to you the following categories of information:

    (a) The categories of Personal Information we have collected about you;

    (b) The categories of sources from which the Personal Information is collected;

    (c) Our business or commercial purpose for collecting, selling or sharing Personal Information;

    (d) The categories of third parties to whom we disclose Personal Information, if any;

    (e) The specific pieces of Personal Information we have collected about you;

    (f) If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:

    (i) Sales, identifying the Personal Information categories that each category of recipient purchased; and

    (ii) Disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

    Right to Delete (CCPA/CPRA, CPA, CTDPA, TDPA, UCPA, VCDPA)

    You have the right to request that we delete your Personal information that we collect about you. However, please note that we may not delete your Personal Information if it is reasonably necessary to:

    (a) Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

    (b) Help to ensure security and integrity to the extent the use of the consumer’s Personal Information is reasonably necessary and proportionate for those purposes;

    (c) Debug to identify and repair errors that impair existing intended functionality;

    (d) Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

    (e) Comply with the California Electronic Communications Privacy Act;

    (f) Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;

    (g) Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us (h) Comply with an existing legal obligation; or

    (i) Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.

    Right to Correct (CCPA/CPRA, CPA, CTDPA, TDPA, VCDPA)

    If we maintain inaccurate Personal Information about you, you have the right to request us to correct that inaccurate Personal Information. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate Personal Information.

    Right to Data Portability (CCPA/CPRA, CPA, CTDPA, TDPA, VCDPA)

    You have the right to obtain Personal Information in a portable and readily usable format to permit transfer of the information to another controller without hinderance.

    Right to Opt-Out (CCPA/CPRA, CPA, CTDPA, TDPA, UCPA, VCDPA)

    You have the right to opt-out of the processing of your information for the following purposes:

    (a) The sale of Personal Information;

    (b) Targeted advertising; and/or

    (c) Profiling for decisions producing legal or similarly legal effects.

    Right Against Non-Discrimination (CCPA/CPRA, CPA, CTDPA, TDPA, UCPA, VCDPA)

    You have the right to not be retaliated against by us because you exercised any of your rights under. This means we cannot, among other things:

    (a) Deny goods or services to you;

    (b) Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;

    (c) Provide a different level or quality of goods or services to you; or

    (d) Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

    Right to Appeal (CPA, CTDPA, VCDPA)

    You have the right to appeal our response to your request with respect to any of your rights described above.

  7. DATA SECURITY AND RETENTION

    The integrity and security of your information is important to us. We take commercially reasonable steps to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is 100% secure. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet. Thus, access to the App should only be done with in a secure environment.

    We will keep your Personal Information while you have an account with us or while we are providing products and/or services to you. Thereafter, we will keep your Personal Information for as long as is necessary:

    • To respond to any questions, complaints or claims made by you or on your behalf;

    • To show that we treated you fairly; or

    • To keep records required by law.

    We will not retain your Personal Information for longer than necessary for the purposes set out in this Privacy Policy. Different retention periods apply for different types of Personal Information and the purposes for which we use the information. When it is no longer necessary to retain your Personal Information, we will delete or anonymize it.

  8. NOTICE TO USERS OUTSIDE THE UNITED STATES.

    The App and its servers are operated in the United States. If you are located outside of the United States, please be aware that your information, including your Personal Information, may be 8 transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to use the App, you hereby irrevocably and unconditionally consent to such transfer, processing, and use in the United States and elsewhere.

  9. APP STORES; EXTERNAL WEBSITES

    Your app store (e.g., iTunes or Google Play) may collect certain information in connection with your use of the App and other usage-based data. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies.

    The App may contain links to third-party websites. We have no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.

  10. CHILDREN. The App is not directed to children under the age of 13. We adhere to the Children’s Online Privacy Protection Act (COPPA) and will not knowingly collect Personal Information from any child under the age of 13. We ask that minors (under the age of 13) not use the App. If a child under the age of 13 has provided us with Personal Information, a parent or guardian of that child may contact us and request that such information be deleted from our records.

  11. PRIVACY POLICY UPDATES

    This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may update this Privacy Policy from time to time. You will be notified of any material changes at the primary email associated with your account. Additionally, any revisions to this Privacy Policy will be reflected at the top of the page with the language “Last Updated” and the associated revision date. '

    By accessing the App after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information. Please refer back to this Privacy Policy on a regular basis.
